Antoinette concentrates her practice in the litigation of complex commercial disputes. She has represented Fortune 50 corporations, financial institutions, small businesses, partnerships and individuals at all levels of the federal and state courts, including the United States Supreme Court. As lead counsel, she has tried numerous cases to final verdict, both jury and non-jury, and has handled litigation matters in courts across the country. Antoinette’s peers have selected her as a Pennsylvania Super Lawyer®, an honor conferred upon the top 5% of lawyers in the state.
Antoinette’s practice covers a range of commercial matters involving contract disputes, intellectual property matters, healthcare issues, civil RICO and other fraud claims, unfair competition and other business torts, lender liability, product liability, defamation actions, litigation against the government and defense of governmental enforcement actions. Some of her more notable engagements include:
- Obtaining a multi-million dollar arbitration award for a Fortune 50 client concerning the disposition of insurance proceeds to finance the remediation of a hazardous waste site
- Obtaining one of the largest settlements in the history of CERCLA and the Superfund program on behalf of a Fortune 50 client against more than 250 defendants
- Defense of a Fortune 50 company as lead defendant in a 62-day federal court trial in one of the first of the few cases in the United States to be tried to verdict under CERCLA, involving more than 50 parties
- Defense of a Fortune 50 company in the mediation of a multi-million dollar federal environmental enforcement action, which resulted in a highly advantageous settlement in record time, saving the client significant litigation costs
- Defense of a major national franchisor in a multi-million dollar contract dispute in which a Texas jury returned a verdict favorable to the client
- Obtaining a verdict for significant past and prospective royalties on behalf of Uzi Gal, inventor of the famed UZI firearms, in a royalties and patent infringement dispute involving the inventor’s designs
- Defense of the Democratic City Committee of Philadelphia in a case involving a challenge to a reapportionment plan, in which the court dismissed the challenge in a decision that was upheld by the United States Supreme Court
- As head of the litigation team, successfully representing Pennsylvania Governor Edward G. Rendell and U.S. Senators Arlen Specter and Rick Santorum in litigation against the U.S. Secretary of Defense involving the 2005 Base Realignment and Closure Act decisions affecting the 111th Fighter Wing of the Air National Guard stationed at Willow Grove Naval Air Station Joint Reserve Base
- Obtaining a dismissal of a lawsuit against a major national health care provider claiming double damages under the Medicare Secondary Payer Act for “medical errors”
- Successful litigation of RICO and fraud claims against bank officers of a savings and loan association, including assistance to the U.S. Attorney in prosecution of the officers, and recovery on bank’s fidelity bond
Antoinette also assists her clients in resolving matters through alternative dispute resolution and litigation avoidance. She has been successful in resolving disputes, before the initiation of litigation, involving employee claims, defamation, contract claims, pricing claims and unfair competition. She frequently serves as a mediator and arbitrator for other parties and has been certified as a mediator and arbitrator in the U.S. District Court for the Eastern District of Pennsylvania.
Prior to entering private practice, Antoinette was an enforcement attorney for the U.S. Environmental Protection Agency and an Assistant U.S. Attorney for the Eastern District of Pennsylvania. She prosecuted a corporate officer in the first criminal case in the United States under the Clean Water Act that resulted in incarceration of the defendant. She also prosecuted cases involving drug and weapons offenses, public corruption and fraud. In private practice, Antoinette advises clients in connection with federal grand jury subpoenas, fraud investigations, search warrants, parallel civil and criminal proceedings and employees who are targets of criminal investigations.
Antoinette writes frequently on topics of interest to the business community, including issues arising out of doing business in the digital economy, environmental regulation and litigation management. She is licensed to practice law in Pennsylvania and has been admitted to appear and has practiced in the United States District Courts for the Eastern, Middle and Western Districts of Pennsylvania, the United States Court of Appeals for the Third Circuit, and the United States Supreme Court, as well as the federal and state courts in fifteen states across the country, and various federal, state and local administrative agencies.
